Seasonal Lighting Terms

These terms apply to every holiday lighting quote from Frostpeak Holiday Lighting LLC. Approving your quote means you agree to them.

1. Services. Frostpeak Holiday Lighting LLC ("Frostpeak") will design, supply, install, maintain for the season, remove and store the holiday lighting display described in your quote (the "Display") at your service address.
2. The lights are leased, not sold. All lights, clips, cords, timers and other materials remain the property of Frostpeak. You have use of them for the season only. Please don't remove, move or alter the Display. If you want a change, call or text us and we'll take care of it.
3. Season and schedule. The season runs from installation until takedown. Installations are scheduled October through mid-December on a first-come basis. Takedown happens between January 2 and January 31. Dates may shift for weather, ice, wind or safety, and we will let you know if they do.
4. Price and payment. The season total is shown on your quote. A 50% deposit reserves your install date, and the balance is due when installation is complete. If the balance is not paid within 30 days of installation, Frostpeak may remove the Display.
5. Service calls are included. During the season, if a bulb, strand or timer that we supplied stops working, call or text us. We will repair or replace it at no charge, typically within two business days, weather and safety permitting. Service calls caused by damage from people, pets, animals, vandalism, other contractors or changes you make may be billed at a quoted rate.
6. Your responsibilities. You will: provide working outdoor GFCI outlets within reach of the Display and pay for the electricity used; give access to the exterior of the home and yard on scheduled dates (gates unlocked, pets secured); tell us about hazards such as fragile gutters, solar panels, sprinkler heads or buried lines; and get any HOA approval the Display needs.
7. Care for your home. We attach lights with clips and do not drive nails, staples or screws into your roof, gutters or siding unless we agree in writing first. Frostpeak is not responsible for pre-existing conditions such as loose or damaged gutters, shingles, trim or paint. If Frostpeak damages your property through its own carelessness, Frostpeak will repair it or pay the reasonable cost of repair.
8. Outages outside our control. Frostpeak is not responsible for the Display being dark because of power outages, tripped breakers or outlets, or severe weather, but we will help get it back on when it is safe to do so.
9. Our equipment. You are not responsible for normal wear or weather. You are responsible, at replacement cost, for Frostpeak equipment that is lost, stolen, or damaged by you, household members, guests, pets or your other contractors.
10. Cancellation. You may cancel for a full refund of the deposit up to 7 days before the scheduled install date. After that, Frostpeak may keep the deposit to cover materials prepared for the Display and the reserved install slot. Once installation is complete, the season total is not refundable, including if you ask for early removal. Frostpeak may cancel and refund all payments if it cannot safely perform the work.
11. Limitation of liability. To the extent allowed by law, Frostpeak's total liability is limited to the amount you paid for the season, and Frostpeak is not liable for indirect or consequential damages. This does not limit liability for gross negligence or willful misconduct.
12. Next season. We would love to light your home again. Frostpeak may offer returning customers first pick of install dates. These terms cover one season only and do not renew automatically.
13. General. These terms are governed by Colorado law. Together with your approved quote, they are the entire agreement between you and Frostpeak for the season. Changes must be agreed in writing, and text or email counts. If any part is found unenforceable, the rest remains in effect.
